MINISTRY RESOLUTION (RESOLUCÍON MINISTERIAL No. 001)

CONSIDERING:

That the Law 2061 of the 16th March 2000 provides for the creation of the National Service for Livestock Health and Food Safety - SENASAG, a public institution independent from the Ministry of Ariculture and Rural Development, responsible for the administration of the Regulation on Livestock Health and Food Safety.

That the Decreto Supremo No. 25729 of the 7th April 2000 establishes the organization and functions of SENASAG, and that Article 7k) thereby assigns SENASAG the responsability of regulating the import, use and any other activities involving Living Genetically Modified Organisms, in coordination with other national institutions concerned with this matter.

That it is necessary, so as to be able to provide guarantees to external markets and Bolivia’s trading partners, to establish national measures that regulate or ban the import of products, subproducts and foodstuffs derived from genetically modified crops, in accordance with the Montreal Biosafety Protocol signed the 30th January 2000.

That the Government and public institutions have the inescapable obligation of protecting public health by adopting precautionary measures, given that foods derived from genetically modified crops are still subject to studies in order to test for possible health effects.

DECIDES:

FIRST.- To ban, for a period of one year, the import of products, subproducts and foodstuffs of agricultural origin derived from genetically modified crops.

SECOND.- Food importers shall certify that their products are not derived from genetically modified crops.

THIRD.- SENASAG will regulate the process of control of imports, in order to ensure compliance with this Resolución Ministerial; this Service is given the authority to provide and periodically update a list of the products that are subject to this regulation.

FOURTH.- SENASAG will regulate the import and use of Living Genetically Modified Organisms, within 360 days since the publication of the present Resolución Ministerial.

FIFTH.- From the date of approval of the present Resolución Ministerial on, the import of foodstuffs for human consumption will comply with the labelling rules issued by SENASAG, that will provide in the individual label, in addition to the technical information related to the product, the following information:
– Identification of the manufacturing company
– Country of origin of the imported product
– Identification of the distributor authorised in Bolivia, with company address and legal seat.
Those products which do not comply with this labelling rules will be regarded as smuggled goods and hence will be withdrawn.

SIXTH.- Importing companies are to apply to SENASAG in order to adapt the registration of their products to comply with above article and with the rules stablished by the Service.

In order to make this procedure feasable

SEVENTH.- SENASAG will request the Ministry of Health and Social Welfare to provide all the information regarding the registration of foodstuffs and food industries.

EIGTH.- SENASAG will act in coordination with the Customs, so as to ensure that custom clearing procedures comply with the present Resolución Ministerial.

The National Director of the National Service for Livestock Health and Food Safety is given the mandate of implementing and ensuring compliance to the present Resolución Ministerial.

Shall be registered, made public, and filed.
